1. Introduction
Flow33, operated by Nitrotech Inc. ("Company," "we," "us," or "our"), provides AI-powered video and image content creation tools and services ("Services").
This Refund Policy ("Policy") explains our rules, restrictions, and procedures for refunds under the contractual laws of the State of Delaware, United States, where our company is incorporated.
By purchasing any subscription plan or credit pack, you confirm that you:
- Have read and accepted this Policy
- Agree to our Terms of Service and Privacy Policy
- Acknowledge that digital services are subject to the terms outlined below
2. Legal Basis for Refunds
2.1 Digital Goods
Flow33 provides digital services including AI-generated videos, images, and related content. Once digital content is generated or credits are consumed, the service has been substantially performed. Under Delaware contract law, refunds are subject strictly to the terms of this Policy.
2.2 Fair Treatment
Despite the nature of digital services, Flow33 offers a fair, conditional refund system as outlined below to balance customer satisfaction with operational sustainability.
3. Subscription Refunds
3.1 Refund Request Window
- Full Refund: Request within 7 days of initial subscription purchase, provided less than 25% of monthly credits have been used
- Partial Refund: Requests within 7-14 days may be eligible for prorated refunds based on unused time and credits
- No Refund: Requests after 14 days or with more than 50% credits consumed
3.2 Yearly Subscriptions
For yearly subscriptions, refunds are calculated based on the time remaining in the subscription period and credits consumed. Refunds are prorated using the monthly rate equivalent.
3.3 Subscription Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain access until the end of your current billing period
- Your remaining credits stay available until the period ends
- Rolled-over credits from previous months are preserved until period end
- No partial refunds for the current billing period after 14 days
4. Credit Pack Refunds
4.1 One-Time Credit Purchases
- Full Refund: Request within 3 business days if no credits have been used
- Partial Refund: If less than 25% of purchased credits have been consumed within 3 days
- No Refund: After 3 days or once 25% or more credits are consumed
4.2 Credit Preservation
Unlike some competitors, we do not deduct your previously rolled-over or separately purchased credits when processing a subscription refund. Only the credits included with the refunded subscription period are affected.
5. Automatic Credit Refunds (Technical Failures)
Automatic Refunds for Failed Generations
If content generation fails due to a technical error on our part (server error, AI service failure, timeout, etc.), we automatically refund the credits consumed by the failed operation to your account. This refund is processed automatically and does not require action from you.
Automatic credit refunds apply to:
- Server errors during video or image generation
- AI provider service failures
- Timeout errors where no content was delivered
- System crashes during content processing
6. Refund Process
6.1 How to Request a Refund
Refund requests must be submitted via email to support@flow33.io with the following information:
- Your account email address
- Date of purchase
- Reason for refund request
- Any relevant transaction IDs
6.2 Review Process
We will review your request and verify:
- Credits consumed since purchase
- Time elapsed since purchase
- Content generated or downloaded
- Compliance with Terms of Service
6.3 Refund Timeline
- Refund requests are reviewed within 2 business days
- Approved refunds are processed within 5-10 business days
- Refunds are issued to the original payment method via Stripe
7. Account Status After Refund
7.1 Subscription Refunds
Upon subscription refund approval:
- Your subscription is cancelled immediately
- Credits from the refunded subscription period are revoked
- Previously purchased credit packs are preserved
- Your generated content and media library remain accessible
- You may continue using any remaining purchased credits
7.2 Credit Pack Refunds
Upon credit pack refund approval:
- Unused credits from the refunded pack are removed
- Subscription credits and other purchases remain unaffected
- Your account remains active
7.3 Content Preservation
Unlike some services, we do not immediately delete your generated content upon refund. Your media library and generated videos/images remain accessible. However, without an active subscription or credits, you will not be able to generate new content.
8. Non-Refundable Items
Refunds will not be granted for:
- Subscriptions active for more than 14 days
- Credit packs older than 3 days
- Accounts with more than 50% credits consumed
- Subscriptions in Month 2 or later of a multi-month period
- Accounts that have violated our Terms of Service
- Fraudulent or abusive refund behavior
- Dissatisfaction with AI-generated content quality (credits are refunded for technical failures only)
9. Chargebacks
We encourage you to contact us directly before initiating a chargeback with your bank or credit card company. Chargebacks result in:
- Immediate account suspension pending investigation
- Additional fees that may be passed to you if the chargeback is found to be fraudulent
- Potential permanent account termination

10. Data Protection
Data collected for refund processing (name, email, payment information) will be processed solely to complete the refund and for financial record-keeping as required by law.

11. Disclaimer of Warranties
All Services are provided "as is" without warranties of merchantability, fitness for purpose, or non-infringement, to the fullest extent permitted by Delaware state law. AI-generated content may not always meet your expectations, which is why we provide automatic credit refunds for technical failures.
12. Limitation of Liability
To the maximum extent permitted by Delaware law, Flow33 is not liable for indirect, incidental, or special damages. Our liability is capped at the subscription or credit pack fee paid for the disputed billing period.
13. Amendments
This Policy may be updated from time to time. Any material changes will:
- Be posted with a new "Last Updated" date
- Be communicated to active subscribers via email
- Become effective 30 days after notification
14. Governing Law & Jurisdiction
This Policy is governed by the laws of the State of Delaware, United States. Any disputes arising from this Policy shall be resolved in the state or federal courts located in Delaware.
